Ashley St. Clair takes Musk to court for full custody of their son R.S.C.

Ashley St. Clair has launched a legal battle against billionaire Elon Musk, demanding sole custody of their baby boy. Court documents reveal that Musk has barely seen the child since birth. St. Clair claims he has met their son only three times, with the last visit in November 2024. Filing in New York

On February 21, St. Clair filed a custody petition with the New York Supreme Court, asserting that New York is the child’s home state. The boy, identified as R.S.C., was born in September 2024. St. Clair insists Musk was absent at the birth and has remained uninvolved in his development. She maintains that despite his status and wealth, he has not taken the necessary steps to be a responsible father, leading her to take this legal action to protect her son’s best interests.

Paternity questions

Despite naming Musk as the father, St. Clair also filed a paternity petition to establish legal confirmation. She states their romance began in May 2023 and claims they conceived the child in January 2024. She believes Musk should formally recognize his responsibility and contribute both emotionally and financially to raising their son. By filing for both paternity and custody, she aims to secure a stable future for R.S.C. while ensuring Musk fulfills his obligations.

Proof of parentage

St. Clair has provided text messages as evidence of Musk’s acknowledgment of their child. Shortly after the birth, she sent Musk a photo of the newborn, and she claims he responded, “I look forward to seeing you and him this weekend.” She also alleges Musk once wrote, “If I make a mistake on security, [R.S.C.] will never know his father.” These messages, included in her court filings, serve as proof that Musk was aware of his son’s existence but still failed to be present in his life.

Rare meetings

According to St. Clair, Musk first met his son on September 21, 2024, spending only two hours with them that day and one hour the next. She says the final visit was on November 30, lasting just 30 minutes. Shockingly, she claims Musk texted her a week before that, saying, “I want to knock you up again.” This message, along with another from three months later where he reportedly stated, “Well, we do have a legion of kids to make,” has raised questions about his true intentions regarding their relationship and the child they share.

Legal action escalates

Her representative, Brian Glicklich, said that St. Clair pursued every option before taking legal action. She has now formally requested a court order to establish paternity, demand financial support, and settle custody matters. Despite her efforts to reach an agreement outside of court, Musk’s lack of cooperation has left her no choice but to seek legal intervention. The case is now moving forward as St. Clair fights for what she believes is in the best interest of her son.

Unresponsive legal team

St. Clair’s lawyer, Karen B. Rosenthal, has accused Musk’s legal team of being uncooperative. She claims they attempted private negotiations with Musk’s attorney, Alyssa Rower, in an effort to settle custody and financial support matters. However, Musk allegedly refused to engage in productive discussions and made it clear he was unwilling to resolve these issues amicably. This unwillingness to negotiate has forced St. Clair to take her battle to court, where she hopes to secure the support her child deserves.

Rosenthal also noted that serving Musk with legal documents at the White House would be impossible due to security measures. This complication arises because of Musk’s involvement in the Trump administration. The legal team is now seeking alternative methods to ensure that Musk is properly served and required to address the claims against him in court. Given Musk’s high-profile status, handling this case within the legal system presents unique challenges.

Musk’s growing family drama

Musk already has 13 children with four women, and this latest custody fight with St. Clair adds to the drama surrounding his personal life. The lawsuit comes just one day after singer Grimes, the mother of three of Musk’s children, publicly pleaded with him to address their child’s medical emergency. In a desperate message posted on X, she accused Musk of ignoring their child’s critical health condition and failing to respond to calls, texts, or emails. She warned that their child could suffer lifelong consequences if Musk continued to neglect the situation.
