ATLANTA — Governor Brian Kemp of Georgia is currently focusing on plans to limit the amounts awarded in lawsuits, although his recent address to business executives centered more on enhancing infrastructure and educational initiatives.

During his speech to the Georgia Chamber of Commerce, the Republican governor indicated that his reform proposals are still being finalized, with further information expected to be made public by the end of the month.

“We’re just dotting the I’s and crossing the t’s,” stated spokesperson Garrison Douglas, highlighting the significance of the undertaking.

Instead of focusing on legal reforms, Kemp proposed allocations from the state’s substantial $11 billion surplus. He expressed a desire to invest an additional $1 billion in infrastructure, building on the state’s $1.5 billion contribution from the prior year.

In addition, Kemp emphasized his commitment to enhancing the guidance provided to students regarding college and career opportunities, aiming to align high school education with post-secondary training and assess the overall effectiveness of such programs.

Previously, Kemp assured the chamber that he would push for limits on lawsuit claims and substantial jury verdicts, a movement often referred to as “tort reform.” Advocates believe that Georgia’s legal environment allows excessive lawsuits against businesses, healthcare providers, and property owners, consequently driving insurers away and resulting in higher insurance premiums.

Typically, Kemp would have introduced his plan early in the legislative session that commenced this week. However, the complexities surrounding lawsuit limitations intersect with a range of political affiliations. Opposition arises not only from Democrats but also from Republican legal professionals. In 2024, Kemp enacted a law to compile data regarding the costs associated with lawsuits as he explored various reform strategies.

“This is not a partisan issue,” Kemp asserted during his address. “Regardless of your party, district, zip code, or background, this matter affects us all.”

Several Republican leaders, including House Speaker Jon Burns, Lieutenant Governor Burt Jones, and Senate Majority Leader Steve Gooch, have also identified lawsuit reform as a legislative priority.

However, critics argue that such reforms would hinder the ability of Georgians to seek justice for grievances against corporations, physicians, and other entities. They further contend that there is insufficient evidence linking the current legal framework to soaring insurance costs in the state.
