Wisconsin GOP to allocate electoral votes for Trump according to federal regulations, overriding state law

MADISON, Wis. — On Tuesday, Wisconsin Republicans will gather to cast the state’s Electoral College votes for President-elect Donald Trump, following a determination by elections officials and the state Department of Justice that this aligns with federal regulations. This meeting will not occur a day earlier as state law stipulates.

Last week, the Wisconsin Republican Party initiated legal action to clarify which date they should convene. After discussions, the state Department of Justice and the Wisconsin Elections Commission reached a consensus that the votes must be cast on Tuesday in adherence to federal guidelines. Consequently, the Justice Department requested the lawsuit be dismissed.

U.S. District Judge James Pederson granted the dismissal of the case on Thursday, as all involved parties recognized the necessity of complying with federal law, rendering the lawsuit irrelevant.

While state law mandates that electors convene on the first Monday following the second Wednesday in December, federal law specifies that the meeting must occur on the first Tuesday after the second Wednesday. This discrepancy led the Republican-controlled Wisconsin Legislature to attempt to address the matter in the previous session. A bill aimed at aligning state law with federal requirements was passed by the Senate with a substantial majority of 31-1 but ultimately did not proceed to a vote in the Assembly.
