Judge mandates Alabama city to permit gay pride float in Christmas parade

PRATTVILLE, Ala. — A federal judge has mandated that an LGBTQ+ pride organization be permitted to participate in the Christmas parade hosted by the city after the mayor initially barred their involvement due to vague safety concerns.

U.S. District Judge R. Austin Huffaker Jr. determined that the city’s decision violated Prattville Pride’s First Amendment right to free speech, as well as the 14th Amendment right to equal protection, particularly when the prohibition occurred just one day prior to the scheduled parade.

In his opinion, Judge Huffaker stated that the city’s removal of Prattville Pride from the event stemmed from a belief that some members of the public might react disruptively to the group’s participation. He asserted that discrimination based on the content of a message is unacceptable under the First Amendment.

The judge ordered the city to ensure the provision of at least two police officers to accompany the float during the parade.

Following this ruling, Prattville Pride requested that law enforcement enhance security measures for the parade. However, in a statement released by Mayor Bill Gillespie Jr., the group was entirely barred from the event due to “serious safety concerns.”

Judge Huffaker noted that while there had been vocal opposition from some residents regarding the pride group’s appearance in the parade, the city had failed to present any credible evidence of genuine threats of physical harm.

The mayor’s office shared a statement via the city’s social media in light of the court’s decision. “The City acknowledges and respects the Court’s ruling and will adhere to the order. Ensuring the safety of all parade participants remains a top priority,” officials conveyed.

Following the decision, Prattville Pride expressed their joy on social media, stating, “The Christmas parade is a beloved tradition, and we’re thrilled to celebrate with our community and friends, embodying love, joy, and unity.”

Prattville is a small city with a population of around 40,000, situated just north of Montgomery, the state capital.
