In a landmark case in New Mexico, a jury has awarded over $412 million to an individual in a medical malpractice lawsuit against a multi-state men’s health clinic. The verdict was announced earlier this week, and the plaintiff’s legal team expressed their hope that this ruling will deter similar fraudulent practices that, they claim, have endangered numerous patients through unsafe medical procedures.
The case unfolded in Albuquerque, where the jury heard accusations stemming from a lawsuit that was initiated by the man’s attorneys back in 2020. Named in the suit were NuMale Medical Center and its officials, facing serious claims regarding misdiagnosis and improper medical treatment.
According to the allegations, the man, then 66 years old, sought help at the clinic in 2017 due to issues related to fatigue and weight loss. Instead of receiving appropriate care, he allegedly underwent invasive “erectile dysfunction shots” that led to irreversible harm. His attorney, Nick Rowley, described the clinic’s actions on social media as part of a fraudulent scheme designed to exploit elderly men, falsely warning them of irreversible damage unless they consented to frequent injections.
Rowley emphasized that the clinic engaged in misleading practices, coercing patients under the pretense of urgent medical necessity. Following the jury’s announcement, Brad Palubicki, the President of NuMale Medical Center, released a statement asserting the company’s dedication to maintaining high standards of care. He indicated that NuMale plans to contest the verdict through legal channels, including an appeal.
The clinic, which has a presence in various states such as Colorado, Florida, Illinois, Nevada, Nebraska, North Carolina, and Wisconsin, faces scrutiny as the court determined that their actions displayed both fraudulent and negligent behavior, resulting in significant damages to the plaintiff. The jury’s decision also highlighted that their conduct transgressed the Unfair Practices Act.
