BOSTON — A member of the Massachusetts Air National Guard, who admitted to leaking highly classified military information regarding the conflict in Ukraine, is poised for sentencing in federal court on Tuesday.

Prosecutors are advocating for a 17-year prison sentence for Jack Teixeira, labeling his actions as one of the most severe breaches of the Espionage Act in U.S. history. They stated, “As a member of the United States Armed Forces and a clearance holder, the defendant took an oath to defend the United States and protect its secrets — secrets that are vital to U.S. national security and the physical safety of Americans deployed overseas.” They emphasize that Teixeira repeatedly violated his oath over the span of more than a year.

On the other hand, Teixeira’s legal representatives are urging U.S. District Judge Indira Talwani to impose an 11-year sentence. In their memorandum, they acknowledged their client’s grave misjudgment, which occurred repeatedly over the course of 14 months.

“It’s a crime that merits serious consequences,” the attorneys stated. “Jack has fully accepted responsibility for his actions and is prepared to accept whatever punishment is deemed necessary.”

Teixeira, who hails from North Dighton, Massachusetts, pleaded guilty in March to six counts related to the willful retention and transmission of national defense information, as outlined in the Espionage Act. His plea came nearly a year after he was arrested in one of the most significant national security leaks in recent years.

The 22-year-old confessed to unlawfully acquiring some of the country’s most sensitive confidential information and distributing it to other users on Discord, a social media platform. While prosecutors indicated they would pursue a longer prison sentence following Teixeira’s guilty plea, his defense highlighted that an 11-year term would effectively equate to half of his life to date.

The defense characterized Teixeira as an individual on the autism spectrum who is socially isolated and spends a significant amount of time online engaging with his community. They asserted that, despite the legality of his actions, he never intended to harm the United States and noted that he had no prior criminal history.

“His goal was to inform his peers about global events to prevent them from being misled,” the attorneys contended. “For Jack, the war in Ukraine represented a pivotal moment akin to World War II or Iraq, and he sought companionship in sharing that experience.”

In rebuttal, prosecutors argued that Teixeira possesses sufficient awareness to discern right from wrong, dismissing the relevancy of his post-arrest diagnosis of “mild, high-functioning” autism in this case.

The breach sparked significant concerns about the protection of classified information in the U.S. and compelled the Biden administration to respond quickly to mitigate the resulting diplomatic and military repercussions. It also led to embarrassment for the Pentagon, prompting tightened security measures and disciplinary action against those who neglected to address Teixeira’s suspicious activities.

Teixeira, a member of the 102nd Intelligence Wing at Otis Air National Guard Base, served as a cyber transport systems specialist, essentially managing military communication networks. According to an Air Force official, he remains in an unpaid status within the Air National Guard.

Authorities revealed that Teixeira initially documented classified materials he accessed before sharing images of files marked with SECRET and TOP SECRET. Prosecutors indicated that he attempted to erase evidence prior to his arrest, with investigators discovering a destroyed tablet, laptop, and an Xbox console in a dumpster outside his residence.

The leaked information exposed the stark realities of Russia’s actions in Ukraine, including troop movements and supplies provided to Ukrainian forces. Teixeira also acknowledged that he divulged information regarding plans by a U.S. adversary to threaten American personnel stationed abroad.
