A proposal to modify the abortion ban in Arkansas won’t be on the ballot as the secretary of state discovered that organizers failed to submit necessary documents regarding the paid canvassers who helped collect signatures. However, similar measures will be up for vote in at least five other states, as well as a sixth state considering an amendment to prevent discrimination based on “pregnancy outcomes.” Several other states are still assessing if related measures will qualify for this year’s ballot, such as Nebraska, where there may be competing abortion-related questions.
Following a 2022 Supreme Court ruling that eliminated the nationwide abortion right, a movement has emerged to have voters decide on abortion-related issues. Since the ruling, most Republican-led states have implemented new abortion restrictions, including 14 states with bans at all stages of pregnancy. Conversely, most Democratic-led states have laws protecting abortion access.
Voters in seven states have favored abortion rights supporters in previous votes since 2022, including California, Kansas, Kentucky, Michigan, Montana, Ohio, and Vermont. In the upcoming 2024 elections, several states are set to tackle abortion-related measures. These include:
**Colorado:** A measure to incorporate abortion protections into the state constitution, which would necessitate 55% of voter support to pass.
**Florida:** Advocates collected enough signatures to place a constitutional amendment legalizing abortion until viability on the ballot. Currently, abortion is banned in Florida after the first six weeks of pregnancy.
**Maryland:** Voters will weigh in on enshrining the right to abortion in the state constitution. Abortion is permitted in Maryland until viability.
**Nevada:** A ballot question to solidify abortion rights in the state constitution will be presented to voters in November.
**South Dakota:** A proposal to ban restrictions on first-trimester abortion will be up for vote this fall.
**New York:** A reproductive rights question barring discrimination based on pregnancy outcomes is on the ballot.
**Arizona:** Abortion rights advocates submitted signatures to place an abortion access measure before voters in November.
**Missouri:** Supporters submitted signatures for a measure seeking to guarantee abortion until viability.
**Montana:** A proposed constitutional amendment would prevent the government from denying the right to abortion before viability.
**Nebraska:** Competing abortion measures might appear on the ballot in November, including one to enshrine the right to abortion until viability and another to maintain the current law restricting abortion after the first 12 weeks.
Various efforts aimed at restricting or banning abortion have failed in different states, such as Arkansas, Wisconsin, Iowa, Pennsylvania, Louisiana, Maine, and Minnesota.
