Roberts Cautions on Intense Rhetoric Toward Judiciary

    In a recent address, Chief Justice John Roberts highlighted the rising threats against judges, cautioning that the intense rhetoric from public officials can contribute to such dangers. While not naming anyone explicitly, Roberts alluded to remarks made by prominent figures from both political parties, including references to former President Donald Trump and Senate Democratic leader Chuck Schumer.

    At an assembly of legal professionals and judges in Charlotte, North Carolina, Roberts emphasized that political disagreements can unjustly embroil judges in controversy, noting that judges may become targets merely for fulfilling their judicial duties. “The danger is that someone could act on those heated words,” he stated, citing serious threats that have emerged against judges, including potential violence and murder.

    Roberts’ comments came during the 4th U.S. Circuit Court of Appeals judicial conference, just a day after the Supreme Court concluded its term with decisions that included a significant win for Trump. This ruling curtails judges’ authority to broadly block policies through nationwide court orders. The Chief Justice’s dialogue with Judge Albert Diaz, the 4th Circuit’s chief judge, was broadcasted by C-Span.

    The Chief Justice has previously voiced opposition to Trump’s characterizations of judges. In 2018, he countered Trump’s labeling of a judge as an “Obama judge” after the judge blocked Trump’s migrant asylum policy. Roberts also dismissed calls for the impeachment of judges following Trump’s attacks on those ruling against his deportation efforts.

    In 2020, Roberts criticized Senator Schumer for ominous statements directed at Supreme Court Justices Brett Kavanaugh and Neil Gorsuch regarding an abortion case. Schumer later admitted his choice of words was inappropriate. More recently, an alarming incident unfolded when a man, armed and intending harm, was apprehended outside Justice Kavanaugh’s home in Washington. This individual, Nicholas John Roske, plead guilty to attempted murder charges in April.

    Roberts’ remarks underscored the need for restraint and consideration among political leaders to prevent their words from inciting real-world threats towards the judiciary.
