Today, he has transitioned to NASCAR ownership with his team, 23XI Racing, which along with Front Row Motorsports, has initiated legal action against NASCAR, accusing them of antitrust violations. Polk, now singled out in NASCAR’s countersuit, is accused of orchestrating resistance among the race teams regarding revenue-sharing agreements.

    NASCAR’s countersuit, filed earlier this month, portrays Polk as a pivotal figure in the opposition against the current charter agreements implemented by most Cup Series teams last fall. Their claims included allegations of him threatening to boycott Daytona 500 qualifying races and discouraging teams from attending critical meetings. Despite the signed charters, seen by some as imperfect yet beneficial for guaranteeing event participation and financial incentives, 23XI and Front Row resisted to include clauses prohibiting lawsuits against NASCAR, aiming to keep open the possibility of legal recourse over antitrust issues.

    With legal battles looming, NASCAR has suggested dismantling the charter system altogether, a proposal that has sparked considerable debate. Christopher Yates, representing NASCAR, criticized Polk for misunderstanding the unique nature of motorsport compared to other professional leagues such as the NBA. However, Jordan, aligning closely with Polk, views the legal challenges as more than business disputes—they are personal. Polk, a minor stakeholder in 23XI alongside Jordan and notable driver Denny Hamlin, is seen as an essential force pushing for innovation and progress within the team.
