The online auction for the ball marking Shohei Ohtani’s 50th home run is currently in its final days, with the highest bid reaching an impressive $1.8 million.

However, this auction is not without controversy, as it is entangled in a legal dispute regarding the possession of the ball. Christian Zacek claims to have walked away with the ball after a game at Miami’s LoanDepot Park, while two individuals, Max Matus and Joseph Davidov, are disputing his claim through separate lawsuits, stating they obtained the ball first.

Ohtani has made history as the first player to hit 50 home runs and steal 50 bases in a single season, achieving this remarkable feat on September 19, when he hit his second homer out of three against the Marlins.

In an update to the ongoing legal proceedings, Zacek was previously misidentified as Chris Belanski in the lawsuits. Matus’s revised lawsuit now correctly identifies Zacek and eliminates Goldin Auctions from the case.

“The contract with Goldin selling the ball resides with Christian Zacek,” stated John Uustal, Matus’s attorney. “While there was confusion regarding his identity at the ballpark, we can confirm our lawsuit is accurately targeting Zacek, who is the rightful signatory.”

All parties involved have reached an agreement to allow the auction to run its course. Zacek’s legal team released a statement underscoring this agreement, emphasizing that it provides assurance to potential buyers that the sale of the historic 50/50 baseball will be uncontested.

Matus’s lawsuit alleges that he, who was celebrating his 18th birthday at the time, was the first to gain possession of Ohtani’s ball before Zacek intervened. Davidov’s suit puts forth that he was able to “firmly and completely grab the ball in his left hand while it was on the ground, successfully obtaining possession of the 50/50 ball.”

Davidov is pursuing over $50,000 in damages as part of his claim.

As of now, the auction’s highest bid stands at $1.8 million; however, the ultimate price for the buyer will approach nearly $2.2 million once additional fees are factored in. The auction is set to conclude on Tuesday.
