New York’s highest court permits ‘equal rights’ amendment to be included on November voting ballot

A recent ruling by New York’s highest court confirms that a proposed amendment to the state’s constitution aimed at preventing discrimination based on “gender identity” and “pregnancy outcomes” will be presented to voters in November. The Court of Appeals upheld a previous decision from June, declining to review the case further as no significant constitutional issues were identified.
The upcoming ballot measure has become a focal point for Democrats, who view the “equal rights” amendment as a means to safeguard abortion rights and drive voter turnout in their favor during the fall elections. On the other side, Republicans are strategizing on how to capitalize on opposition to the amendment, especially concerning protections for transgender individuals.
A Republican state legislator had initiated legal action to halt the ballot question, alleging that Democrats had committed a procedural error when passing the amendment through the Legislature.
