Marketing company penalized $40,000 for distributing 2022 GOP mailers in New Hampshire

A political marketing firm based in New Hampshire has agreed to pay a $40,000 fine to resolve accusations that the flyers it produced during the 2022 state primary election violated regulations. Deliver Strategies, the company behind the campaign materials, generated 189,000 mailers labeled “Robert Burns for Congress” without Burns’ involvement, failing to include the mandatory “paid for” disclosure, according to the state’s attorney general’s office. Robert Burns emerged victorious in the Republican primary for the 2nd Congressional District but was defeated by incumbent Democratic Rep. Annie Kuster in the subsequent general election.
Following an investigation by the attorney general’s office, no criminal charges were filed, partly because of uncertainties regarding whether federal law would take precedence over the state law in question. By agreeing to the settlement, Deliver Strategies did not acknowledge criminal responsibility.

In addition to the monetary penalty, the firm committed to educating its staff on adhering to relevant regulations.
